By commissioning any Artwork from DMNDEM (also referred as "Artist"), the Client is stating that they have read and agreed with the following Terms:


------ ✦ GENERAL ✦ ------1. / Artist retains copyright, ownership and redistribution rights to the Artwork and other materials produced during the process (WIPs, speedpaints etc.), which includes but is not limited to: display, printing, advertising etc.
^{* May not apply to commercial commissions.}2. / Artist reserves the right to decline requests based on content, subject,
or other reasons without further explanation.
Sending a request does not guarantee the Commission will be accepted.3. / Artist may define scope of work, features, price and other details for the project in form of private message through Discord or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.4. / Client warrants that the character design and references provided to the Artist are legally obtained and authorized for use by the Client.5. / Any part of the Artwork should not be used for NFT, AI/ML, tracing and
should not be edited/modified in any way without permission from the Artist.6. / Client receives exclusive usage rights for personal use and must credit the Artist using their username/link at the instance of display of the Artwork.Personal use means: display on social media for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print for personal use; display as a part of designs on websites (e.g. Toyhouse).

------ ✦ PAYMENT ✦ ------1. / Payment is accepted upfront via Hipolink or EasyStaff.
Payment plans for commissions above 100 USD are allowed.
Down payment discussed with the Artist.2. / Initial payments are due within 7 days once commission was accepted, unless other agreements were set prior.
If payment has not been sent within agreed period and delays were not communicated - commission will be cancelled by the Artist.3. / Сlient understands that their commission cannot be refunded due to the regulations of payment methods beyond the Artist's control.However, Client may request to change the character / type or specifications of their commission, if progress for current Artwork is no further than a draft.4. / Client can cancel their commission if payment has not been sent yet.


------✦ DEADLINES & WORKFLOW ✦ ------1. / Order, deadlines and progress info for commissions are posted on Artist's ✦ Trello ✦.2. / Client must communicate any specific deadlines prior if needed, otherwise general approximate deadline will apply.
In case the deadline needs to be extended - Client will be informed.3. / Artist provides progress updates voluntarily during following stages:
✧ sketch → line art and color/shading draft → finished artwork ✧
_{Any additional updates should be requested by the Client as needed.}4. / Completion of the Artwork requires 2 to 4 weeks for sketches and
4 to 6 weeks for full illustrations/reference sheets.
_{Those are estimate deadlines that will depend on complexity and current workload.}5. / Finished Artwork(s) will be delivered via e-mail or Google Photo album
in .png format, not including work files (.psd, .csp).

_{Client is advised to not share their Google Photo link with any third parties, otherwise Client does so at their own risk and is solely responsible for any unauthorized usage of their files.}

Some Artwork types may be delivered in .gif and .png format via Discord and/or ToyHouse transfer (e.g: premade DPs, adopts).


------ ✦ REVISIONS✦ ------1. / Up to 2 major revisions on the sketch stage and 1 major revision on the line art/color stage are free of charge.2. / Additional charges for further revisions may be required.3. / Additional revisions may affect progress and timeline.4. / It is in Clients' interest to provide proper references to the Artist with all required details/traits visible and to communicate any important details on early stages to minimize revisions and time required for Artwork completion.

------✦ CONFIDENTIALITY ✦ ------The Artist and Client acknowledge that information and materials provided to either party (including but not limited to personal information, payment information), shall be considered confidential and shall not be disclosed to any third party without prior written permission from the owner.

------✦ COMMERCIAL ✦ ------Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.Commercial use should be mentioned in Client's request if Artwork is intended to be used on streaming platforms or any monetized instances, or sold as a part of any product on any platform.Additional charges will be required, cost depends on intended usage and starts from 50% of the base price.

------✦ RESELL ✦ ------
(DPs and adopts only)1. / Adopts may be resold with Artist's permisson.
If you wish to resell a character designed by DMNDEM, please contact
via ✦ ToyHouse ✦ or ✦ Discord ✦.2. / DPs should only be resold within our ✦ Discord server ✦.
Retext fee should be paid by a new owner.3. / Upselling is prohibited, unless any additional value added to the character. Resell price may not exceed original price + any additional purchased art.
Gifts and giveaway pieces cannot be resold/added to the value.4. / Violation of resell rules can lead to permanent ban from Artist's services as well as our Discord server.
